Terms of Service

Effective date: 2026-05-19

These terms govern your use of the ausdata.io API and related services ("the Service") operated by Harry Vass, based in Australia. By creating an account, generating an API key, or making a request, you agree to these terms.

1. What the Service does

A hosted REST API + MCP servers wrapping publicly available Australian Government data ABS, RBA, ATO, APRA, AIHW, ASIC, AEMO, BOM (via Open-Meteo), WGEA, and identity registers. We normalise upstream formats into a uniform JSON envelope. We do not originate the data. We pass through what the source agency publishes.

2. License grant

API code is FSL-1.1-MIT (becomes MIT two years after each release). The 10 sister MCP packages on PyPI are MIT. Underlying data is licensed by the publisher: ABS/RBA/Open-Meteo CC-BY 4.0; ATO/APRA/AIHW/ASIC/WGEA CC-BY 3.0 AU; AEMO per their public terms. When republishing data, you must carry the attribution field returned on every response.

3. Acceptable use

You may use the Service for any lawful purpose, commercial or non-commercial. You may NOT: resell bulk exports as if they were yours; circumvent rate limits via account rotation; harass third parties; reverse-engineer for resale; strip the stale_reason/retrieved_at provenance fields.

Building products on top of the Service is exactly what it's for.

4. Account suspension / termination

We may suspend for non-payment after a 7-day grace period, breach of acceptable use, or valid Australian legal process. You can terminate anytime from the Stripe customer portal.

5. Disclaimers

Data is provided as-is. We surface upstream errors and staleness via stale_reason but don't independently verify agency figures. Nothing constitutes financial, tax, legal, or medical advice.

6. Limitation of liability

Total liability capped at fees paid in the 12 months preceding any claim. Not liable for indirect / consequential / special damages. Nothing here excludes the Australian Consumer Law's consumer guarantees.

7. Refunds

14-day pro-rated refund per ACL. After 14 days, monthly billing, non-refundable for the current period, access continues to period end.

8. Changes

30 days email notice for material changes (price, tier removal, breaking endpoint changes). Non-material changes anytime.

9. Governing law

Victoria, Australia. Disputes resolved in Victorian courts.
